These Terms and Conditions (“Terms”) govern your access to and use of the website, services, consultations, diagnostics, strategy, and ongoing governance services provided by Emily Braveheart, doing business as Prosperity Ridge Business Services (“Braveheart,” “we,” “us,” or “our”). By accessing our website, booking a call, purchasing a service, or otherwise engaging with Braveheart Business Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use our website or services.
1. Business Identity
Prosperity Ridge Business Services is operated by Emily Braveheart, a sole proprietor, doing business as Prosperity Ridge Business Services. The business intends to be registered in Mohave County, Arizona, United States.
2. Eligibility
Our services are available only to individuals who are 18 years of age or older. We work with:
- Business owners and operators
- Authorized or approved representative agents acting on behalf of a business entity
- Sole proprietors and independent operators
The businesses we support may operate on a B2B (business to business) or B2C (business to consumer) basis. By engaging our services, you represent that you are either the owner of the business or have the authority to bind the business to these Terms, and that you meet these eligibility requirements. Prosperity Ridge Business Services and Emily Braveheart relies on the client’s representation of authorization and does not independently verify internal decision-making authority.
3. Scope of Services
Emily Braveheart dba Prosperity Ridge Business Services provides consulting and advisory services, including but not limited to:
- Marketing and business diagnostics (including the Digital X-Ray™)
- Strategy and systems design
- Sequencing and planning
- Governance and oversight of chosen services
- Guided DIY or managed, done-for-you governance retainers
We do not guarantee outcomes, execute tactics without agreement, or replace the role of implementation vendors unless expressly stated in a written agreement.
A free qualification call may be offered at our discretion. All services beyond that call are paid engagements.
4. One-Off Services
Digital X-Ray™ Diagnostic
The Digital X-Ray is a one-time diagnostic service. Payment is required in full and upfront prior to service delivery. This service is non-refundable.
5. Strategy, Engineering, and Retainer Engagements
a. Deposits
For engagements that progress beyond the Growth Readiness Report into strategy engineering and vendor sourcing:
- A non-refundable deposit of $750 is required to cover time spent on strategy refinement, agency sourcing, bid review, and system design.
- The total required deposit is $2,000, which includes the $750 non-refundable portion.
- The remaining deposit amount is applied to the first month of services, if a retainer is approved.
If the parties do not proceed into an ongoing agreement, the non-refundable portion remains earned for services rendered.
b. Commencement of Services
Ongoing governance services officially begin once:
- Strategy, sequencing, and final bids are approved by the client, and
- The remaining balance for the first month of services is paid in full.
Recurring monthly invoices will be issued thereafter.
6. Payments, Late Payments, and Suspension
- All payments are due upfront, unless otherwise agreed in writing.
- No refunds are issued for any services rendered.
- If payment is more than five (5) days late, Emily Braveheart dba Prosperity Ridge Business Services reserves the right to temporarily suspend or deactivate:
- Paid software tools
- Advertising campaigns
- SMS and email campaigns
- Platform access or governance activities
Services will resume only once all outstanding balances are paid.
7. Usage-Based Services and Third-Party Costs
Clients may be required to fund deposits or prepaid balances for usage-based or third-party services, including but not limited to:
- SMS and email platforms
- Domains
- Web builders
- Applications, plugins, or software tools
- Advertising platforms
These costs are the client’s responsibility and are non-refundable, as they are governed by third-party terms.
8. No Guarantees and Disclaimer of Results
Emily Braveheart dba Prosperity Ridge Business Services makes no guarantees regarding outcomes, revenue, growth, performance, or results.
All projections, estimates, forecasts, timelines, and strategy proposals are informational estimates only. Actual results may vary significantly based on factors outside our control, including but not limited to:
- Market conditions
- Product-market fit
- Execution quality
- Budget
- Client decisions and responsiveness
Marketing inherently involves risk. By engaging our services, you acknowledge and accept this risk.
9. Professional Services Disclaimer
Emily Braveheart dba Prosperity Ridge Business Services provides business, marketing, and strategic consulting services only. We are not a law firm, accounting firm, financial advisory service, or investment advisor, and nothing provided through our services should be construed as legal, financial, tax, or investment advice.
Clients are encouraged to consult with their own licensed professionals regarding legal, financial, tax, or regulatory matters before making business decisions.
10. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete information
- Making final business decisions
- Approving strategies, bids, and vendors
- Implementing or overseeing implementation unless otherwise agreed
- Compliance with applicable laws and platform policies
Emily Braveheart dba Prosperity Ridge Business Services is not responsible for failures caused by incomplete information, delayed approvals, or decisions made against professional recommendations.
11. Termination
Either party may terminate an ongoing engagement by providing at least fourteen (14) days’ written notice. A thirty (30) day notice period is preferred to allow orderly transition and asset facilitation.
Upon termination:
- No fees are refundable
- Emily Braveheart dba Prosperity Ridge Business Services will reasonably cooperate in facilitating the transfer of client-owned assets, including access to campaigns, accounts, software settings, copy, and media assets
Refunds will be issued only in rare circumstances where Emily Braveheart determines, in good faith, that it is morally and professionally appropriate.
12. Intellectual Property
a. Emily Braveheart Intellectual Property
All frameworks, methodologies, diagnostic systems, templates, processes, and proprietary materials developed by Emily Braveheart and/or Prosperity Ridge Business Services remain the exclusive intellectual property of Prosperity Ridge Business Services, and, Emily Braveheart, whether or not they are shared with the client.
b. Client Deliverables
Once strategy documents, growth plans, reports, or presentations are delivered to the client:
- The client owns the right to use those deliverables for their business
- The client may apply the strategy across websites, advertising, content, hiring, or other business activities
Emily Braveheart retains the right to reuse generalized, non-confidential concepts, structures, and learnings across future work.
13. Limitation of Liability
To the maximum extent permitted by law:
- Emily Braveheart dba Prosperity Ridge Business Services shall not be liable for any indirect, incidental, consequential, special, or punitive damages
- Total liability, if any, shall be limited to the total fees paid by the client to Emily Braveheart dba Prosperity Ridge Business Services in the two (2) months preceding the claim
This limitation applies regardless of the theory of liability.
14. Dispute Resolution
The parties agree to attempt to resolve any dispute through good-faith mediation before pursuing formal legal action.
If mediation fails, disputes shall be resolved through the appropriate state or federal courts located in Arizona, subject to applicable law.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.
16. Privacy and Related Policies
Use of our website and services is also governed by our:

- Refund Policy
- Unsubscribe and Preference Management Policy
These policies are incorporated by reference.
17. Modifications
Emily Braveheart dba Prosperity Ridge Business Services reserves the right to modify these Terms at any time. Updated Terms will be posted on the website with a revised effective date. Continued use of services constitutes acceptance of the updated Terms.
